TERMS AND CONDITIONS FOR GASH LUXE

Welcome to Gash Luxe! These Terms and Conditions ("Terms") govern your access to and use of the Gash Luxe mobile application ("App"), owned and operated by Gash Luxe ("we," "us," or "our").

By downloading, installing, or using this App, you agree to be bound by these Terms. If you do not agree to these Terms, please immediately delete the App and do not place any orders.

1. Account Creation & Security

To purchase items through Gash Luxe, you may be required to create a user account.

  • Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.

  • Account Safety: You are solely responsible for safeguarding your account password and for any activities or actions under your account. You must notify us immediately of any unauthorized use of your account.

  • Age Restriction: By creating an account, you confirm that you are at least 18 years of age or accessing the App under the supervision of a parent or legal guardian.

2. Product Listings, Availability, & Pricing

As a single-vendor store, all products displayed on the App are sold directly by Gash Luxe.

  • Stock Availability: All items are subject to availability. We reserve the right to limit the quantity of products we supply or to refuse an order if an item goes out of stock before the system updates.

  • Pricing Errors: We strive to ensure all pricing information is accurate. In the rare event that a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel any orders placed for that product and issue a full refund.

  • Visual Representation: We make every effort to display the colors, textures, and designs of our products as accurately as possible. However, we cannot guarantee that your mobile device's screen will display the colors exactly as they appear in person.

3. Shopping Cart, Orders, & Contract Formation

  • Add to Cart: Placing an item in your shopping cart does not reserve the item or its price. Stock is only secured once the checkout process is fully completed and payment is processed.

  • Order Confirmation: After you place an order, you will receive an in-app confirmation and/or an email receipt. This confirmation indicates that your order request has been received, but does not constitute final acceptance of the order.

  • Order Cancellation: We reserve the right to accept or decline your order at any time after receipt for valid reasons, including suspected fraud, unauthorized payment details, shipping restrictions, or inventory shortages. If we cancel an order after payment, a full refund will be issued.

4. Payments

  • Payment Channels: All payments must be made through our authorized, integrated third-party payment gateways (including credit/debit cards or mobile money options as supported by the App).

  • Authorization: By completing a transaction, you authorize our third-party payment processors to charge the total order amount (including product prices, applicable taxes, and delivery fees) to your selected payment method.

  • Security: We do not collect or store your financial credentials. All payment processing is subject to the privacy policies and terms of the respective payment processors.

5. Shipping, Delivery, & Logistics

  • Delivery Area & Times: Gash Luxe delivers to specified geographic regions. Delivery timelines provided at checkout are estimates and are not guaranteed. We are not liable for delays caused by third-party courier services, weather conditions, or traffic.

  • Delivery Address: You are responsible for providing a precise and accurate physical delivery address and a reachable phone number. If a package cannot be delivered due to an incorrect address or an unreachable recipient, you may be responsible for secondary delivery fees.

  • Risk of Loss: The risk of loss and title for items purchased pass to you upon our delivery of the items to the carrier or delivery agent.

6. Returns, Exchanges, & Refunds

  • Return Window: If you are unsatisfied with your purchase, you may request a return or exchange within [Insert Number, e.g., 7 or 14] days of receiving the item.

  • Condition of Items: To qualify for a return or exchange, items must be unused, unwashed, in their original packaging, and with all original tags attached. Hygiene-sensitive items (such as undergarments or cosmetics) may not be eligible for return.

  • Refund Process: Approved returns will be refunded via the original payment method or as store credit, minus any non-refundable delivery fees, within a reasonable processing timeframe.

7. Prohibited Uses of the App

You agree not to misuse the Gash Luxe platform. Prohibited activities include, but are not limited to:

  • Using the App for any unlawful purpose or to solicit others to perform unlawful acts.

  • Attempting to bypass, disable, or interfere with any security-related features of the App.

  • Using automated scripts, bots, or scrapers to extract data or manipulate the shopping cart system.

  • Creating multiple fraudulent user accounts to exploit promotional discounts or coupon codes.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Gash Luxe and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or connected to your use of the App or any products purchased through it. Our maximum liability to you for any claim arising out of an order will not exceed the total amount you paid for that specific order.

9. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of [Insert Your Country/State, e.g., Uganda], without regard to its conflict of law principles.

10. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our App. It is your responsibility to check our App periodically for changes. Your continued use of or access to our App following the posting of any changes constitutes acceptance of those changes.
